An agreement enforceable by law is a contract. All agreement are contracts if they are made by the free consent of parties competent to contract, for a lawful consideration, and with a lawful object, and are not expressly declared to be void under the contract act, 1872. Nothing herein contained shall affect any law in force in India, and not hereby expressly repealed, by which any contract is required to be made in writing, or in the presence of witness, or any law relating to the registration of documents.

Who are competent to contract - Every person is competent to contract who is of the age of majority according to that law to which he is subject and who is of sound mind, and is not disqualified from contracting by any law to which he is subject.

A person is said to be of sound mind for the purpose of making contract if, at the time when he makes it, he is capable of understanding it and of forming a rational judgment as to its effect upon his interests. A person who is usually of unsound mind, but occasionally of sound mind may make a contract when he is of sound mind. A person, who is usually of sound mind, but occasionally of unsound mind, may not make a contract when he is of unsound mind.

A valid contract is a legally enforceable document, but then it is not that simple as it sounds. Each contract is an extremely carefully worded document as it governs the relationship between two parties. These contracts are always worded in such a manner that an ordinary person might not find anything wrong with it, but the many hidden risks would be noticed by the trained eyes of a lawyer.
